These Terms of Service (the “Terms”) govern your use of sarahprimiano.com (the “Site”) and any purchases you make through it. Please read them carefully. By using the Site or placing an order, you agree to these Terms.

1. Acceptance of Terms

By accessing the Site, browsing our store, or placing an order, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

2. About the Site

The Site is owned and operated by Sarah Primiano, a sole proprietor based in San Antonio, Bexar County, Texas. References to “we,” “us,” or “our” in these Terms refer to Sarah Primiano in that capacity.

3. Eligibility

You must be at least eighteen years old to make a purchase, or have the permission and supervision of a parent or legal guardian who accepts these Terms on your behalf. By placing an order you represent that you meet this requirement.

4. Account and Order Accuracy

You are responsible for providing accurate and complete information when placing an order, including your shipping address and contact email. We may refuse, cancel, or limit any order, including orders that appear to be fraudulent, contain pricing errors, or that we are unable to ship.

5. Products and Pricing

All prices are listed in United States dollars and are subject to change without notice. Applicable sales tax, where collected, is shown at checkout. Product availability is not guaranteed; we may discontinue or limit quantities of any item at any time.

6. Orders and Payment

Payment is processed by Square. By placing an order, you authorize us to charge the payment method you provide for the full amount of the order at the time it is placed. We do not store your full card details; that information is handled directly by Square in accordance with PCI-DSS.

7. Shipping

We ship within the United States via standard carriers such as USPS or UPS. Orders are typically processed within three to five business days, though processing time may be longer during book launches or holidays. Estimated delivery times are provided by the carrier and are not guaranteed. Risk of loss and title for items pass to you upon our delivery to the carrier. We do not currently offer international shipping.

8. Returns and Refunds

We accept returns within 30 days of delivery for unsigned books in their original, unused condition. Signed or personalized books are final sale and are not eligible for return. To qualify for a return, items must be in original condition with no visible wear, damage, or markings. Customers are responsible for return shipping costs unless the item arrives damaged or defective.

If your order arrives damaged or defective, please contact us within 7 days of delivery and include photos of the item and its packaging, along with any applicable carrier documentation. Once reviewed, we will offer a replacement or a full refund, including return shipping if necessary. Refunds are issued to the original payment method through Square and are typically processed within 5–10 business days after the returned item is received.

All content on the Site, including book text, cover art, photographs, marketing copy, and design elements, is the property of Sarah Primiano or her licensors and is protected by United States and international copyright and trademark law. You are granted a personal, non-exclusive, non-transferable license to view and enjoy the content for your own non-commercial use.

You may not reproduce, redistribute, scrape, or otherwise exploit any part of the Site or its content for commercial purposes without our prior written permission, including for the training, fine-tuning, or evaluation of artificial-intelligence or machine-learning systems.

The Site links to or embeds services operated by third parties, including Square (payment), Goodreads, Instagram, TikTok, and others. We do not control these services and are not responsible for their content, privacy practices, or availability. Your use of any third-party service is governed by that service’s own terms.

The Site and its content are provided on an “as is” and “as available” basis. We make reasonable efforts to keep information accurate but make no warranty, express or implied, that the Site will be uninterrupted, error-free, or that any information on it is complete, current, or fit for any particular purpose.

13. Limitation of Liability

To the maximum extent permitted by Texas law, our total liability for any claim arising out of or related to the Site or your purchase will not exceed the amount you paid us for the order giving rise to the claim. We will not be liable for any indirect, incidental, consequential, special, or punitive damages, even if we have been advised of the possibility of such damages.

You agree to indemnify and hold harmless Sarah Primiano from and against any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Subject to Section 16, you and we agree that the exclusive jurisdiction and venue for any dispute will be the state and federal courts located in Bexar County, Texas.

Before filing any formal action, you agree to first contact us at [email protected] and give us thirty days to resolve the dispute informally. If we cannot resolve it, either party may bring an individual claim in small-claims court in Bexar County, Texas, if it qualifies, or in the state or federal courts described in Section 15. We do not require mandatory arbitration.

17. Severability and Entire Agreement

If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding your use of the Site.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes will be posted prominently on the Site. Your continued use of the Site after a change takes effect constitutes acceptance of the revised Terms.
